Algeria is a member of the Paris Convention for the Protection of Industrial Property and, since 31 July 2015, of the Madrid Agreement Concerning the International Registration of Marks. It follows the Nice International Classification of Goods and Services, including the revision of Class 42 and the addition of Classes 43–45 adopted on 1 January 2002. A single application may cover goods and/or services in any number of classes against an additional fee for the extra classes.
Upon filing, a filing certificate showing the filing number and date is issued within approximately one week. Applications are examined for registrability in light of previously registered marks, and the registration certificate is issued once all filing requirements are completed. Marks are published after registration; there are no provisions for opposition.
Under Trademark Law No. 03-06 of 2003, a registered mark is protected for 10 years from the filing date, renewable every 10 years upon application and payment of the prescribed fees, with a six-month grace period for late renewal against the prescribed fine.
A mark may be assigned with or without the business. Changes to the owner's name or address must be recorded. Licence agreements may be recorded; an unrecorded licence agreement is not effective. Use of a mark in Algeria is not a condition for filing, registration or maintenance of protection; however, a registration may be cancelled where an interested party obtains a court judgment to that effect — based primarily on proof of no genuine use for three years after filing, or an interruption of use exceeding three years. Unlawful use of a registered mark is punishable under the law in force.
